PROGRAMS FOR STUDENTS WITH DISABILITIES AND LEAST RESTRICTIVE ENVIRONMENT 

The case conference committee (CCC) of a student with disabilities shall determine and annually review the placement in which the student will receive services, and the Board shall ensure a continuum of placement options is available to the CCC. The student’s placement is based on the student’s IEP and should be in the school that the student would attend if not disabled unless the IEP requires some other arrangement (if another arrangement is required, the placement should be as close as possible to the student’s home school). 

To the maximum extent appropriate, students with disabilities shall be educated with nondisabled students. Special education services should be delivered in the general education environment unless removal from the general education environment is deemed necessary by the nature and severity of the student’s disability that education in the general education classes using supplementary aids and services cannot be satisfactorily achieved. In selecting the least restrictive environment, the CCC shall consider any potential harmful effect on the student or quality of services needed.  

Services shall be delivered in the least restrictive environment determined by CCC, regardless of the student’s identified disability. Services may be delivered at the same time, in the same classroom, to students with different disabilities. 

Students with disabilities shall be educated in classes and buildings with their chronological peers unless an alternative is deemed appropriate by the CCC and written notice is provided. Students with disabilities shall not be removed from education in age-appropriate general education classrooms solely because of needed modifications in the general curriculum. 

Western Wayne Schools (“Corporation”) shall ensure a continuum of services is available to meet the individual needs of students with disabilities, including general education classroom, supplementary services provided in conjunction with general education placement (such as resource room or itinerant instruction), self-contained classrooms, separate nonresidential schools or facilities, residential schools or facilities, or a homebound or hospital setting. Settings outside of the Corporation school will be considered only when determined necessary for the provision of a free and appropriate public education by the student’s CCC.  

Each student with a disability shall have an equal opportunity to participate with nondisabled students in nonacademic and extracurricular services and activities to the maximum extent appropriate. 

Article 7 

Evaluations shall be conducted in compliance with the requirements of 511 I.A.C. 7-40-5, including, but not limited to, the requirement to ensure English learners are not mistakenly identified due to their language barriers. 

Discipline for special education students is subject to the requirements of 20 U.S.C. 1415 et seq.
